Prior to the introduction of the Regulatory Reform (Fire Safety) Order 2005 fire safety measures for buildings and their processes were mainly policed by the local authority Fire Service under the umbrella of the Fire Precautions Act.
The introduction and adoption of the Order allowed for obsolete legislation to be replaced and fire safety measures to be applied objectively rather than prescriptively. This has also allowed for greater control and responsibility by the owners and operators of buildings for the fire safety measures necessary.
They include as defined in the Order:
Failure to comply with the provisions of the Order may result in the imposition of penalties as described in the Order section 29 to which could result in prosecution and conviction leading to a fine or imprisonment. A person on whom a notice is served has 21 days from the date of service in which to appeal as described in Section 35 of the Order.
